Online dispute resolution
The Centre offers Online Dispute Resolution and an online Virtual Courtroom with video-conferencing facilities.
Introduction
Technology has matured to the extent that dispute resolution does not necessarily require, nor will it be limited to, personal interaction at a court, arbitration or mediation. While these traditional forms will not disappear, there will be a greater reliance on non face to face methods.
Online workspace
The purpose of the online workspace is to support dispute resolution. The online workspace will provide the following capabilities:
- the secure electronic submission of documents, pleading and other evidence;
- online workspace for management and collection of all materials related to a matter;
- a facility to carry out interlocutory proceedings online;
- virtual meeting facilities including teleconference and video conferencing; and
- instant reference to precedents and legislation
Online ADR facilities
Typically to support Expert Determination where the parties make all submissions electronically and the dispute resolver delivers his or her findings electronically.
The TDC will provide a platform product which will be provided to various customers and institutions on a fee-for-service basis. The platform will be a secure internet-based product, through which parties may lodge the initial dispute and then have the dispute resolved.
The platform will be customised to the particular requirements of the relevant referring body.
